RETRENCHMENT TAX DIRECTIVE

I trust i find you well.

If i apply for an involuntary retrenchment tax directive, and I need to deduct the severance benefit over a period of 3 months will there be an issue when submitting my EMP501 if i add the lumpsum under the details of directives the 3 months amounts each month or must i add the total lump sum amount that i apply for, for instance the lump sum amount is R7034.39 and i deduct  R2344.79 for 3 months.

    Yes, you are able to split the payment across multiple months. However, it is crucial that the amount on the Details of Directive matches the total amount on the IRP5. For example, if the Details of Directive indicate R900, the total amount on the IRP5 code should also be R900.

    One potential issue to be aware of is that if the payment is split over three months—such as from August (within the first six months) to October (within the second six months)—the mid-year export might produce an error in the validation report. This error can occur if the Directive value (on the Details of Directive screen) does not align with the amount reported on the 3901 report. For more details on this advised error, click here.

    For instance, if you record R900 on the Details of Directive screen and R300 on the IRP5 code (payslips) for August, you may encounter this validation error because the mid-year submission considers only the first six months of the financial year (March to August) and would not consider the additional R600 you would pay in September and October. 

    To avoid this validation error, you may seek further assistance from your tax practitioner or your accredited Sage Business Partner.
