Overtime calculation

Good morning,

I just have a short question regarding overtime calculation.

The rule says:

Overtime hours in respect of a work week are the greater of:

· the total of an employee’s hours of work in excess of 8 hours on each work day in the

work week, or

· an employee’s hours of work in excess of 44 hours in the work week.

If the greater of the 8 or 44 hours are the same, then overtime hours are those common hours.

But does that mean, that I have to check each week separately (if our payroll period is biweekly) and I can take for the first week the OT in excess of 8 hours in for the second week the OT in excess of 44 hours. 

Or do I need to add the OT of work in excess of 8 hours for the TWO weeks and the OT for work in excess of 44 hours for TWO weeks and then I have to decide which amount the greater amount is?

    You appear to be in a different province than I am, so your overtime rules are a little different than mine. However, the rules appear pretty clear - calculate each week's overtime separately. And yes, the result could be different for week 1 than for week 2.

    What they are saying is the if an employee works more than 8 hours in one day then the excess hours for that day are paid as overtime rate.
    If an employee only worked 8 hours every day for 5 days in one week but also worked an extra day for 6 hours then the employee worked 46 hours that week so therefore 2 hours from extra day is paid at overtime rate since that is over 44 hours per week.
    If an employee worked 10 hours on day one and 8 hours for day 2, 3 ,4 and 5, then an extra day for 6 hours resulting in total of 48 hours then 2 hours from day 1 is paid at overtime rate and 2 hours from extra day is paid at overtime rate.
    If an employee worked 10 hours on day one and 8 hours or less every day for day 2, 3, 4, and 5 resulting in total of 42 or less hours then 2 hours from day 1 is paid at overtime rate from day 1 since that is over the 8 hours per day limit.
    Hope this clarifies how to look at what is considered overtime hours.
