FPS "Have you conducted a Right to Work check?"

I am just about to start sending my FPS for this week and note that the following is included in the Important Notice page of the FPS: "You have selected to submit the FPS details for ...... to the Government Gateway and, on an anonymous basis, send details of how you answered the "Have you conducted a Right to Work check?" field to the Home Office" I have just updated Sage 50 Payroll to v22.02.254 and note that on the employees employment page a "Right to Work" box now appears with drop down options of No, Yes or I'm recording this elsewhere. As my client's employee has worked for the business for years, do we need to enter one of the options in the box or is this something that is just needed for new employees? To my recollection this question wasn't previously asked when entering new employees so may be something which is now asked on the newer version of the program. Any advice would be greatly appreciated as I need to submit these reports today. Many thanks Jan
  • Hi Jan,

As an employer, you have a legal obligation to ensure that anyone you're employing has the right to work in the UK, by carrying out the necessary checks.

With Sage 50 Payroll v22.02, you can easily record details about the checks you carry out and the type of documents your employees provide to confirm their right to work. You can also attach a copy of the document used in your check, to an employee record.

The right to work details on an employee record are also included in a full payment submission (FPS) as Home Office Data.

Full info on right to work checks in Sage 50 Payroll here.

  • Hi Paul,

As we are a firm of accountants offering payroll services, I will complete the "I am recording this elsewhere" and send our clients a letter asking them to ensure that they hold the relevant documentation for all employees.

    Kind regards,

    Jan
