Employee worked whilst had a sick note

I hope you can help...

We have an employee that had a sick note that expired, but he worked on the last date of the sick note.  He was due to take holidays after that.  The following day after he worked, another sick note was submitted which included the last day of his last sick note, and also the day he worked.

He is now on sick leave and not his holidays.  Do I pay him the day he worked?  How does the SSP get processed?

    Hi Sadie,

    You need to make sure that you are recording the absence record according to the dates on the sick note. Once this is done correctly, the system will automatically calculate Sick Pay for the correct dates.

    As the employee worked one of those days, I would recommend contacting HMRC to see if that day needs to be included in the absence record.

    I would imagine you would need to pay the employee for the days in which he has worked. You can confirm this with your Accountant if unsure.
