BCEA Leave For Severe Illnesses of Employees Children

SUGGESTED

Hi there

My client has an employee whos child (a todler) has got cancer which results in the emoloyee on a regular basis not being able to go to work because of frequent doctor appointments for the child.

3 days Family Responsibility Leave is not enough for an instance like this. Taking annual leave and unpaid leave is also not a solution here because this is a chronic case.

Is there any special kind of leave for these severe instances?

Please let me know if any of you have any knowledge on this matter.

Thanks so much in advance

Hi MelanieJean, this is a difficult situation and your question does not have a straight forward answer. The employer would need to decide how they would like to handle this situation as there are no definite guidelines for situations such as these. The BCEA defines how family leave should be handled as a minimum and all other instances outside of the guidelines will need to be decided upon by the employer. I really hope there is another member on this forum that has experienced the same and is able to offer some guidance. All the best Heidi
